Question 1&2 Assignment Example | Topics and Well Written Essays - 500 words

Question 1 - Assignment Example In this case, privacy is not viewed as being alone or away from others but is based on matters such as trespass to a person’s personal property. The contravention of the law of slander and libel demands that remedy be attained through treatment of a person’s feelings which tends to interfere with the right of privacy. Absolute protection of the right to privacy may limit the ability of an individual to access other rights which are closely tied. The right to property may not be fully achieved if an individual wants to maintain their right to privacy as the property may be located in a place near other people. c) Protection against libel and slander is not sufficient in the protection of privacy because its remedy only involves the treatment of mere wounded feelings instead of addressing the actual issues that the led to the breach of privacy. Breach of implied contract is insufficient in the protection of privacy in the sense that it does not allow for free interaction between the offender and the person being offended. Hence it limits the exercise of right of privacy. Loss of property leads to loss of privacy in the search for a lost property or remedy to the loss. a) Soft surveillance uses non harmful means of carrying out investigations in crime scene investigations such as DNA tests from samples taken from body fluids such as the saliva. It involves the application f modern forensic laboratory equipment in the investigation. On the other hand panopticon applies the use of technical forms of investigation that may include deep examination of the body parts of the victims at a crime scene. It may include physical torture of suspects so that they can reveal some information. The collection of information for search is unseen due to the automated systems. The process does not infringe on the privacy of individuals as one is not

Xenophon Essay Example for Free

Xenophon Essay Xenophon, the author of the document, The Constitution of the Lacedaemonians, was born in 434 BC and became a middle-class Athenian but was later exiled to Spartan land (pg. 81). This document was written in order to keep record of the way life was lived back in Sparta where he fulfilled his exile. The law maker, Lycurgus, was a very creative and intuitive man but additionally he was fair and just. Lycurgus made laws that would honestly benefit everyone in Sparta to the fullest extent and differ from the old ways of the other Greeks. The new ways of Sparta stunned the other Greeks by how different and irregular they were. I believe that Xenophon too was fascinated by the laws he now had to abide by and wrote it all down so that others could analyze it as well. In the document Xenophon writes, â€Å"I not only admire [Lycurgus], but consider to have been in the fullest sense a wise man† (pg 82). Xenophon was so fond of Lycurgus and his way of ruling that wanted to save these rules to be studied forever and wrote them down. This can be considered one of the first real constitutions written down in history which gives it such great significance along with the fact that it is a direct account from that time period originally written in a language we code decode. This document was written for any politically involved or scholarly person who wanted to study the ways of the Spartans. Xenophon believed that Lycurgus was as most genius law maker and thought that if he shared his ways maybe everyone else could be as good as Sparta. Lycurgus’ laws were â€Å"contrary to those of most governments† (pg 82) which is why it needed to be written down and spread around. I strongly feel that when Xenophon was exiled he tried to seek out the flaws in the governmental system that had done wrong and subconsciously abandoned all of the beliefs that the old government he used to follow cherished. In order to show their flaws, Xenophon wanted to compare both ways of life. As shown in The Constitution of the Lacedaemonians, Xenophon compares the jurisdiction between the overall Greek and the more sophisticated Spartans. For example, when he writes about the boys as objects of affection, he states that among the other Greeks such as the Boeotians and Eleians, a man and a boy may enter a union and attempt to gain favor of the young boys however, it is sometimes prohibited for them to converse. As learned in lecture, in ancient Greece, during Xenophon’s time, it wasn’t unusual for older men to be attracted to the younger Greek boys however it was not something someone would share in the open. It was referred to in another Greek writing, The Birds by Aristophanes, the two main characters imagine a land where it would be rude for a family friend not to grope another man’s son. This shows just how prevalent the phenomenon of these relations between older and younger men had become in Xenophon’s home. Lycurgus however did not agree that it should have to be so hidden and stated that an older man liked a boy because of his personality and not only due to lust and physical attraction, that it was an excellent thing and should be celebrated (pg 85). Xenophon definitely wrote to inform the general Greek population of this new way of life to those who thus far did not follow and believe in the ways that Lycurgus did. This is probably one of his greatest works not only because it is our best explanation of Spartans rules and community life, but also because it stirred up the governments around Sparta. They tried to get rid of him through exile because of his wrongdoings while he exploits their faulty governmental regulations through his writing which spread much further. Using evidence from the document, it is obvious that Xenophon was not only a true follower of Lycurgus but is a strong ancient day liberalist. Xenophon believed in all of the rules Lycurgus set up which were, at the time, contrary to popular beliefs of those in the other Greek societies. For example, Lycurgus set up a food system in which people were only to take enough to survive. It states that they should â€Å"take only such a quantity as never to be oppressed with repletion, and not to be strangers to living somewhat frugally† so that they would be â€Å"more satisfied with any kind of food† (pg 84). I feel that this shows Xenophon as a warrior or strong willed because he believes that suffering in the end will bring good fortune. This is also shown in the document when he agrees with Lycurgus’ law that one should not wear shoes in order to toughen their feet so they can become stronger and more agile. As a liberalist with a strong warrior background, Xenophon celebrated the strength and intuitive creativity of the Spartan way of life. His attitudes toward all other nations were that they were weak; the way they were set up would not be beneficial to their people. However, after being raised in Athens for all those years, how is it that he just now is changing his views? After being exiled for fighting under the rule of the Spartan king, Xenophon began living his new life as a respectable member of the Spartan community. He wrote a lot and became an active member as well as studied under Socrates, which I believed helped him to see the ways of life from a new point of view. Since the Spartans rules were so different from the others it makes sense that Xenophon would be compelled to write about their lifestyle, which was a powerful and virtuous one at that. I think the fact the these rules seemed to try to push everyone to be the best they could be in every category including virtue (honours paid to old age encouragement of virtue 91), honor (infamy and penalties of cowardice 90), to be humble (obedience to the magistrate and laws 89), and last but definitely not least, physical strength. The environment around them seems to be one with an availability of steep terrain but it is also a city. When addressing that the children should not wear shoes he specifies that it will allow them to go up steep inclines with greater ease so I feel that there are either many steep steps leading towards their great buildings in the city or possibly rough terrain. Another thing I noticed is that the Spartas are very set on being powerful, strong and ready to battle so it is very likely that the warriors in Sparta must be equipped to walk over far, steep distances in order to battle. The surrounding areas of Sparta are possibly spread out from city to city do that one city is not directly touching another Greek city even though they may be close. Again, while addressing the wear of the Spartans, Xenophon states that they need to wear only one outfit so that they can become accustomed to both the cold and heat which leads me to believe that the general climate there was about the same as it would be over here in North America today. As far as the people in Sparta, they are all accustomed to joining in competitions, becoming stronger and becoming the best of the best. Sparta differs a lot from Athens not only based upon its laws but the way the people act and react to one another. In Sparta the women we to be equal to the men; â€Å"the female should practice bodily exercises no less than the male sex †¦expecting that when both parents were rendered strong, a stronger offspring would be born from them. † (pg 82). Not only does this show that the people of Sparta were all about toughness and strength but it goes back to support the idea that Xenophon too was like them and had a warrior like personality about him. Also, they are trying to spread equality between the men and women in ancient Sparta which is something that women are still struggling with today. In the other Greek nations the women are to sit and spin wool, to be sedentary, which would be parallel to the old ideas in American history which would not let women hold places in many jobs, institutions or positions in war. Sparta believes that men and women should both become strong and sturdy, ready for war. Although the women were not completely equal to men, this coincides with the way American women in modern day have worked so hard to become equal to men. One rule in particular that seems very odd is a part of a rule previously mentioned; Citizens are to be frugal when it comes to food. The second part of the rule is that if one does become hungry, it is â€Å"honorable to steal as many cheeses as possible† (pg 84) but on the contrary, if caught doing so, one will be greatly punished. It is like saying that it is not illegal unless caught like in today’s society how underage drinking is one of the most common problems but unless you get caught there won’t be a problem. This rule was likely created in order to make the Spartan people more cunning and creative in order to make them more useful in battle. Also, survival of the fittest may come into play in this situation; It is clear that the Spartan’s were mainly concentrated on being strong and warriors so if one was not smart enough to find ways to steal cheese and felt as though he did not have enough to eat, he would either have to leave Sparta or he may perish. Either way the Spartans would have lost one of their weak links and would become stronger as a whole. This document most clearly tells us that Lycurgus was a very great leader and a liberalist of his days going against all that the other Greeks believed to be true. Not only that, but Lycurgus created one of the strongest nations in which Xenophon quickly felt at home. Although he may not directly state it, Xenophon conveys a sense of bitterness towards the other Greeks by judging everything they do. He makes it seem ridiculous that the rules the follow were ever thought to be substantial laws when he makes remarks that nearly make fun of their way such as when he says things like â€Å"a man should feel ashamed†(83), â€Å"how can we expect women treated thus way should produce†(82), or â€Å"Instead of being rendered effeminate†(84). Although it may be easily miss ed, after given a bit of thought it is clear that Xenophon is, in a way, making fun of the others by calling their men feminine, men shameful and telling them they do not even know how to treat their women. He shoots small phrases and insults to the others in order to diminish their power and pull support over to their side. Clearly he was very successful in using his persuasion technique as the Spartans rules spread to the â€Å"modern ruling classes of England and continental Europe† which both have based their education on the Greek classics (82). This document is a very scholarly piece and gives one of the greatest accounts of history back in ancient Greece on not only the Spartan side but also on the side of all of the other Greek. It gives a good overview of multiple ways of life and sets up a time period in which new laws were being created which would eventually take over the old ways that the others used to follow. It reminds me of when the American’s first made their laws apart from the British rule, although they were a small nation compared to Great Britain, they were powerful and thoughtful in their rule making. Based on the rules that Lycurgus placed on his people, I believe the Spartans could be considered the original revolutionaries. I feel during this time the Athenians looked at the Spartans with distaste and thought they were much smarter than the Spartans who were trying to enforce new, unorthodox rules which would make them stronger. It probably also scared the Athenians a little because their people were not strong and built like the Spartans, instead they had the intelligence, which Xenophon and Lycurgus found to be insufficient anyway as they criticize the way of education used in Athens in the constitution. This document is of great importance as it set up the new way of life and set apart the Spartans from all other Greeks which is part of the reason they are so famous today.

Rate of Diffusion of Potassium permanganate, Potassium dichromate, and Methylene blue1

Rate of Diffusion of Potassium permanganate, Potassium dichromate, and Methylene blue1 1 The Effect of Molecular Weight and Time on the Rate of Diffusion of Potassium permanganate, Potassium dichromate, and Methylene blue1 scientific paper submitted in partial fulfillment of the requirements in General Biology I laboratory under Prof. Diana Rose Gonzales, 1st sem., 2013 2014 _ 2 ABSTRACT The effect of molecular weight and time on the rate of diffusion of potassium permanganate, potassium dichromate, and methylene blue was tested using a petri dish of agar water gel with three wells. The three substances were dropped simultaneously in the petri dish. Potassium permanganate (MW 158g/mole) increased rapidly (14.50 mm) while Methylene blue (MW 374 g/mole) gradually increased (9.50 mm) only. Thus, molecular weight and time affects the rate of diffusion. INTRODUCTION Diffusion is a movement of molecules from an area of higher concentration to an area of lower concentration. The particles will fuse when they are evenly distributed and have reached equilibrium. Potassium permanganate, potassium dichromate, and methylene blue are substances used as indicators and oxidizing agents. Potassium permanganate is used in organic compounds and used commercially to purify water and sanitizer. It is chemically used to regulate certain reducing compounds. Potassium dichromate is used to determine ethanol concentrations in solutions and determine the presence and purity of silver. Researches also suggest that potassium dichromate functions as an agent that cause genetic mutation against DNA repair deficient strains of Escherichia coli. Lastly, methylene blue is used as dye to identify bacteria and nucleic acids. The dye will have the deepest shade of blue when in contact with acids. As indicators and oxidizing agents, the substances stated above must prove that their diffusion must be fast in order to do their functions. Due to their difference in molecular weight, a test was conducted to prove what substance is more recommendable _ 3 to be used in getting the rate of diffusion. To further verify the experiment rate of diffusion was also tested with time. To test this, agar water gel is one of the materials was used. Agar water gel is a substance that functions as a thickener, stabilizer, and emulsifier since it do not melt at room temperature until it is heated to 85oC and more. Also, with a stopwatch the substances were measured (mm) at a regular three minute interval for thirty minutes. The study aims to determine the effect of molecular weight and time on the rate diffusion of potassium permanganate, potassium dichromate, and methylene blue. The specific objectives are 1. to prove that molecular weight affects the rate of diffusion; and 2. to explain why molecular weight must also be observed with time MATERIALS AND METHODS In testing the effect of molecular weight and time on the rate of diffusion of potassium permanganate, potassium dichromate, and methylene blue, agar water gel was used. Three bottles with dropper containing the substances and a petri dish with agar water gel were given to each group. As three members of the group dropped all substances together in the wells of the agar water gel, the stopwatch started simultaneously with it. One member measured each wells of the agar water gel with a ruler to get the initial measurement (mm) of the wells. The group then drew the initial appearance of the experiment (Figure 4.1.). One member was assigned to signal the group if three minutes have passed and the member of the group who is assigned to _ 4 measure the wells will immediately but carefully measure the area with the ruler. There was a regular three minute interval for thirty minutes. After thirty minutes, the group then drew the final appearance of the experiment Figure 4.2. Also, the group computed for the average of the substances by adding all the data that were gathered divided by number of time intervals. To test the effect of time on the rate of diffusion the data gathered were computed by partial rate. Partial rate is computed by subtracting the diameter of colored area immediately (di-1) before the diameter of colored area at a given time (d1) divided by the time when d1 was measured (t1) minus the time immediately before t1 (ti 1). Again, the average of each substances were computed by adding all the date divided by the number of time intervals. A graph comparing the average rate of diffusion of each substance was plotted against its molecular weight in Figure 4.3. Also, a graph comparing the partial rate of diffusion of each substance was plotted against the time elapsed in Figure 4.4 _ 5 Potassium dichromate Methylene blue Potassium permanganate Figure 4.1. Initial appearance of the substances in the agar water gel wells. Potassium dichromate Methylene blue Potassium permanganate Figure 4.2. Final appearance of the substances in the agar water gel wells. _ 6 RESULTS AND DISCUSSIONS As seen in Table 4.2, potassium permanganate (MW 158 g/mole) has the highest average rate of diffusion with 11.32 mm/min, followed by potassium dichromate (MW 294 g/mole) with 10.86 mm/min, and methylene blue (MW 374 g/mole) with 7.95 mm/min. In Table 4.3, potassium permanganate has the highest partial rates of diffusion with 0.35 mm/min, followed by potassium dichromate with 0.32 mm/min, and methylene blue with 0.19 mm/min. This results shows that molecular weight has an effect in the rate of diffusion. When the molecular weight is lower then the rate of diffusion will be higher meaning they have an indirect relationship. Also, with time the rate of diffusion of the substances decreased, meaning time and the rate of diffusion has an indirect relationship. _ 7 SUMMARY AND CONCLUSION The effect of molecular weight and time on the rate of diffusion of potassium permanganate, potassium dichromate, and methylene blue was determined. Each substance was dropped simultaneously with each other into the petri dish with agar water gel. With a stopwatch the time was observed with an interval of three minuets in thirty minutes. After thirty minutes, the average of the circumference and the partial rates of diffusion were computed. Results showed that potassium permanganate (MW 158 g/mole) which has the least molecular weight had the highest average rate of diffusion compared to methylene blue (MW 374 g/mole), which has the greatest molecular weight among the three. In time, the circumference (mm/min) of each substance increased since there was diffusion in the agar water gel wells. Hence, molecular weight and time has an effect in the increase, decrease, slowness, and fastness of the diffusion of substances. Nevertheless, further experimentation must be done to improve the results of the experiment. It is recommended to use other substances, a different medium other than the agar water gel, a longer time period to test the diffusion, a more stable environment, and have more trials to observe better results. _ 11 LITERATURE CITED Dean, John A. Slips Of Fate -the Lottery Essay -- essays research papers

Slips of Fate In the short story 'The Lottery'; by Shirley Jackson, the author uses irony to expand on a theme of traditions that continue although they are ludicrous and barbaric. 'Like a lamb to slaughter'; comes to mind for both the characters in this story and the reader. The characters are honoring a tradition that is handed down to them from former generations. The reader is led through the seemingly normal and quaint little village, and is taken on a ride of ironic horror as they slowly grasp the eventual fate of one inhabitant of the village. The title 'The Lottery'; implies a contest with a winner of some kind, like a sweepstakes. When in reality the winner is actually the loser or person that will die by stoning. The village, by all appearances, seems to be a normal and ordinary place with its inhabitants meeting in a square with festival like intentions. However, the villagers know fully that when the drawing is over, one person in the community will die. Nonetheless, it is tradition. The atmosphere is casual yet anxious. Tessie Hutchinson arrives late because she 'clean forgot'; what day it is. It seems impossible to the reader that anyone would forget a day like lottery day. Her procrastination is logical but her excuse is lame. Mrs. Dunbar tells her son, 'I wish they'd hurry.'; Her anxiousness seems due to dread. She wants the dreaded hour over and done with. However, Mr. Summers states 'Let's finish quickly.'; as if there are other more important tasks that ...

The Life and Times of American POWs in Korea

The world war two as well as the cold war was understood in a different concept from the Korean War. In them the Americans fought for both survival and virtue not Realpolitik, there was little chance in the imaginative minds for negotiation even though the general public had a very simple understanding of the Korean conflict. The U.S government planners tempered them own impressions with such strategy and belief of thrust and parry. The U.S interest in the Korean peninsula is often said to have been limited in that planners were ready to cut their losses in the even that the conflict challenged to undermine the global prepondence of power. Thus, there were various effects whose magnitudes were immeasurable. For instance, the shootings within the peninsula may have been limited, but the magnitude of fear among the fighting soldiers was not.[1] The fighting was so intense and fierce as well as unpredictable that even Seoul, changed hands about 4 times.   Initially the Americans seemed to have won the war when General Douglas until the people’s republic of china got involved in the war. The Chinese army and other communist forces surrounded the Americans to hand them their worst defeat ever. The often called â€Å"great bug out† was a cruel shock and a rude awakening to a nation that had invented the atomic bomb, beat the Axis of â€Å"evil† attained prosperity while rebuilding Europe and with the belief that their Asian counterparts were backward and incapable of mounting any major challenge. The Chinese propaganda machine put a lot of emphasis on allied atrocities as well as conversion of POWs to Marxism. [2]At the early stages of the wrangles ever peace terms Republic of China started relentless changes of germ warfare. A majority of the reports published were supported by confessions relieved from POWs who were under () with often supervision from international inspectors with varying credibility. A large number and probably all the germ warfare confessions were falsified. At the end of the armistice talks, most of what was left was dedicated to the prisoners with the talks lasting for about half the time of the war. More recently the thesis that the Korean prisoners of war certainly prone to collaborate have been judged as a tenacious one, even though it had been meticulously debunked as early as 1963 by the pentagon. The situation in Korea was that of captivity being different rather than the captive. The U.S prisoners were coerced to give confessions in Marxist jargon. Instead of having just a quite session to inform fellows, as had been the case in earlier conflicts. The Korean was encompassed periods of incarceration as cruel as any American encounter, with about a third perishing resulting in a highly coercive atmosphere. If by any chance there was collaboration in Korea, then the situation can best be explained by the demands of the captors as well as the conditions the captive were subjected to instead of just a decline in character of youth. Although the POWs, may not have a permanent or profound revolution in their thought patterns still they were subject to vigorous and routinely indoctrination processes. This kind of methodology was responsible for a large number of collaboration that superficially appeared as a personality transformation. Within the camps, separating officers and â€Å"natural† leaders from the rest of POWs did the segregation. Such tactics like the encouraging race, class as well as political affiliation so as to abrade personal lies and group places among the POWs. Albeit the Chinese forces proclaimed the policy of â€Å"leniency† it was often on the theoretical basis as most the camps were inherently coercive.   In this often-coercive environment the Chinese forces added a forum from where the prisoners could often be minutely scrutinized for compliance. A brief summery of personal accounts from some of the soldiers who took part in the Korean War would probably provide a better insight to the flight of the prisoners of war. After graduating from high school (1950) Tom Gaylets was recruited in the U.S army, fort Knox, Kentucky for a period of six weeks. He later joined his brother and other soldiers who were in Korea. His unit has changed with the duties of blowing up bridges making roads while at same time removing and locating enemies. This particular unit according to tom moved up and down Korea encountering 21 battles in extreme wealthier condition. (summer 100 degrees) to less than 40 degree in winter) the experience according to him was like â€Å"a hell hole because we fought the war 24 hours a day seven days a week†.[3] There was no such a thing as taking a break. The soldiers were always at the frontline. The following year (may 17 1951) tom was called up by his commanding officer with the excitement at the prospect of arriving home was short lived the following morning when Chinese soldiers attacked their division. After a while the Chinese soldiers captured them, they were taken to a holding area until later at night in order to move them. After that the torture exercise began the Chinese made them carry sickness, hunger, and fatigue! They were not offered anything to eat by the Chinese soldiers, and ate anything that they could find on their way.[4] The food that was served to soldiers was terrible though there was a gradual change after some time. For instance there was one point where tom says that they were served rice and noticed some piece of meat in the rice. Thinking that things had changed for better the soldiers were upbeat only to realize the following day that a rat had accidentally gotten in to their food but the Chinese soldiers intentionally ignored and instead went a head to serve it to them. They were not served meat in their meals until some time in 1953. In the course of his stay at the camp as a POW tom says in the book that about 1,500 men died. During the winter seasons the dead soldiers were wrapped and chopped on the hillside without any decent depict an act of dehumanization. Tom himself almost succumbed to death due to various factors like starvation, bouts of dysentery and apparently about 100 pounds.[5] The Chinese soldiers were constantly looking for excuses in order to punish the POWs. A friend was routinely (every morning) put in a four –by- four foot-hole and left for the rest of the day with a hat on his head. After that he would be taken out of every night only to be returned the next morning where he would fill out information with his hat on and then taken back to the hole. When Tom left to go and see some of his friends in the other company the Chinese solders would move him into a hut their start a fire there and leave him closed up for days. Another account by a soldier named David is a description of the deplorable conditions that they were subject to. After eluding the enemy soldiers for a couple of days, David and his compatriot were captured they were then taken through then initial positions and in fields and then hidden under cliff during the day. (Out-doors) they were not offered any sanitation or medical care. The food that was served to them was a brown powder and which was very little in quantity. This state of affairs was routinely carried out until June of 1951 when they were moved to a mining camp. At this stage a large number of prisoners began to die from starvation, while others died as a result of no medical care for the wounds and injuries sustained and others died from torture. Within his camp everyone according to David was plagued with dysentery that resulted in large number of soldiers dying in this camp. After about three months at the camp the soldiers then started moving them out to new camps. The transfer involved a matching process with no food while at the same time some of them were bombed by the U.S B24 which resulted to even more deaths. During the winter seasons some prisoners were given a pair of cotton pajamas but this all they had for the remaining seasons in spite of the fluctuating weather conditions which could go as well as below zero by about 40-50 degrees in the cold season be as lot as this in the included: body lice, dysentery, pneumonia, skin disorders, intestinal disorders, night blindness, beriberi, frostbites and the more insensitive one was the threat to be executed which often accompanied all Out of the approximately 7,190 prisoners of war, who were captured largely in the first months of the war, about 3,000 of them are estimated to have died in captivity about 43% of the mortality were as a result of starvation in a period that last about for six months (Nov 1950-Apr 1951. often the Chinese soldiers communist apologist normally argue that the U.S bombed most of the areas, thereby preventing the delivery of food.[6] However, some soldiers also claim that even though a large apart of the North Korean supply were heavily bombed most of the camps where the POWs were situated were right on the border of china, which had been exempted from bombing. Although the purposeful starvation of the American POWS had ceased in the early summer of 1951, a new phase of treatment greeted the POWs. This phase easy characterized by very disturbing experiences even to the American public than the initial murder by starvation method; the mass indoctrination in propaganda that were anti-American in philosophy often referred as brainwashing as well as the recruitment of the prisoners of war to regurgitate/repeat the learned propaganda in signed statements and even public broadcasts took hold. Even though the â€Å"brainwashing† term eventually fell out of favor, due to the belief by psychologists that the communist indoctrination had no permanent effect on a majority of POWS as soon as they returned, it however was both a mental and physical torture process. In the history of the war they were some points (1950-1951) that are considered significant. For instance, the purposeful starvation of POWs by the Korean and Chinese soldiers often broke the spirit of the prisoners. The resulting effect was that they ceased to help one another. Attempts by most officers to take command, coercing them to cooperate in their common interest, were often thwarted by the communist guards, unless the officers were willing to be collaborators. Some officers took up this choice, for example a Lt. Col Paul Liles and Harry Fleming chose this method by creating communist propaganda, and in return cutting down on the number of deaths in their camps.   Even though these officers were later court martialed, many still believe they played a crucial role in saving many lives that would otherwise have been lost if they had not taken this stance. Elsewhere, many prisoners were too apathetic to defend their comrades and even themselves from the predators and other thugs like James Gallagher and PFC Roth well Floyd. In one particular instance, that has stood out happened in 17 Feb 1951 when Sgt. Gallagher tossed two POWs that had been severely weakened by dysentery from inside the barrack to the cold where they froze to death. The reason given by him was that the body stench and the general stink of the unclean dysentery patients was a revolting one.   Although this may be accurate, when soldiers act as a team and care for one another, the survival rates is gotten very high. There were some prisoners too who were never reported. The U.S authorities had documented about 66 American personnel that had been held back by the communist forces against their will after the war ended. A majority of them had been captured outside of Korea, and as such were not considered under the armistice terms. So far nothing ever came of them over after concerted efforts by diplomatic missions to secure their release. There were about three general phases to the encounters of the POWs per most of the soldiers especially the ones who hired to tell their tale. For instance the soldiers who gave their personal accounts had the experience of marching which can be referred to as the â€Å"marching phase† in this phase the communist soldiers and particularly the Chinese subject the POWs to often walking barefoot while poorly clothed in bitterly cold weather. They were then marched from their points of capture to camps that were situated deep inside North Korea. The second phase which took place until sometime in October 1951 when a majority of the camps were left to the Chinese control, In this phase where a great deal of deaths about 40 percent as a result of starvation, malnutrition as well as denial of Medicare by the unsympathetic north Korean PA guards. Other than malnutrition, starvation and lack of medical care the experience of the soldiers also included such acts like night blindness. Most of the men interviewed have discussed night blindness among prisoners as well as guards, vegetable competing lacking from their diet or in small quantities that do not make up a balanced diet. These are enough conditions about torture lice cold together with dysentery. There are instance where a guard is told who was ready to offer his bag of lunch plus 2 hours head start to any prisoners of war was willing to escape from the prison camps. This is a testimony of the deplorable state of the prisons and the treatment offered to the soldiers. Most of the times there was no medication and if it was provided then it was inadequate with no records at all. Some prisoners were indoctrinated on a daily basis with the sessions lasing from morning to night with just a short break for the Chinese soldiers to have their lunch. In the mean time the prisoners were not offered any food and it is during such times when the brains rushing process began. The perception that was instilled in them was that of repeating communist ideals and philosophy that they had learned in the process.   At night the soldiers would come into the huts and make the soldiers sit while facing eth wall, and warmed with flash lights that shone on the prisoners’ faces, the soldiers made them repeat the communist philosophy References: Harry Spiller, 1998. cather rye essays

cather rye essays Stradlater said, but I knew he probably wouldn't... "Ask her if she still keeps all her kings in the back row." "Okay," Stradlater said, but I knew he wouldn't. (p.33-34) This is seen again when he doesn't trust Stradlater to stop his advances of Jane in the case that she says no. Holden gives up his faith in people to trust him when he boards a bus holding a snowball. The driver refuses to believe that Holden won't throw the snowball so he draws the conclusion that "People never believe you." (p.37). He is also always placing labels upon people as being "phonies" which gives the reader the idea that Holden thinks that others are materialistic. Holdens attempts to protect the innocence in the world is another early sign of his deteriorating state. When Holden goes to Pheobe's school to deliver his note he sees some swearing of the wall which he says "drove me damn near crazy" (p.201). He wipes the words from the wall in an attempt to prevent the inevitable from occuring, leading the reader to believe that he may experience some mental unstability in the future. Eventually he comes to the realization that he can't rub all the profanity away himself. Another example of Holden's attempt to shelter innocence is the fact that he never does call Jane, possibly for fear that she will scar his memories of her as an innocent child. The title of this novel presents this theme to the reader in that Holden wants to be "the catcher in the rye" (p. ) so he can catch all of the children that sway to close to the edge of a cliff in thier play. Perhaps the most obvious example of foreshadowing in the novel occurs when his parents come close to having him "phsycoanalyzed and all" (p.39) when he breaks all the windows in the garage. Throughout the novel he refers to himself as "a madman" (p.79) which gives the reader the idea that he sees himself as having a sort of mental problem. These two peices of evidence alone present a fairly firm idea of what wi ...

Free Essays on Education Defined

Education Most children are taught since the beginning of their educational careers that they must do well, and succeed if they wish to be acknowledged. There was always a black sheep, some boy or girl, who did not do their work and was held back. Consequently, these children were used as horrifying examples of what could happen. However, was the child really at fault for failing to complete grade requirements, or was the system in which they were taught in error? The evidence available demonstrates that children who were retained were not unintelligent, but that education policies were to blame. Although the human race has gone through stupendous scientific awakenings, it is suprising to see that the education policies practiced today are based on the reasoning of a dead age. It is certainly not because Americans do not value their children’s education but perhaps because we live in a country that is not always aware of significant aspects of our society, particularly education. Social promotion, in use nationally for at least 20 years , is an educational policy where students are advanced from grade to grade. There is no regard to their learning because it is a widely accepted notion that they learn better with their peers. â€Å"Studies show that it’s better to promote an underachiever than keep them down,† stated Peg Dawson from the National Association of School Psychologists. Yet, high profile protesters of this system include both United States President Bill Clinton and The American Federation of Teachers. In many cases, children are advanced repeatedly without knowing basic educational skills, and suffer greatly when in high school. Social promotion, used throughout the course of the American educational system as a standard policy, is archaic, and should be altered to address individual student needs, helping to create a future conscientious and prosperous society. Proposal to Write a Research Paper on Climate Change Mitigations

To Write a Paper on Climate Change Mitigations - Research Proposal Example The economy is affected due to the reduction of agricultural outputs that are caused by soil degradation and loss of other resources that are of economically important. People’s social lives are affected by climate change. For instance, when there are floods some people are usually relocated and others left homeless. Many people develop skin cancer due to global warming that is caused by climate change (Department of Ecology State of Washington, 2009). My readers will be the environmental and business students in my school. I have chosen them since they know about the impacts, causes and the mitigations of climate alteration. They also think that atmospheric change is a serious issue and solutions have to be found. In my research, I will use several sources like books and articles to find information about climate change. I will also interview people in our school and my neighborhood using questionnaires about the climate change issues. I will use the following as one of the s ources to study on my research topic. This topic meets the standards for a relevant topic in my future career. Firstly, I have sufficient interest in the topic. As a business and environmental enthusiast, I have realized that mitigating climate alteration effects will bring positive effects to the social and economic aspects in our country. I am deeply interested in the mitigation measure that other environmentalists have practiced. Secondly, the topic meets standards since it can be searched quickly. A computer search in the library has shown numerous sources accessible on this topic. Moreover, our college library has a wide array of possible sources that I believe will produce a unique project. For my project, please allow me to research the ways of mitigating climate change. If you have ideas concerning the changes on this topic, please notify me.

Innovative Organisations - Case Study Example In this paper, the author presents the characteristics of innovations of General Electric (GE). The presentation includes history of GE, innovation characteristics of GE, the most innovative service of GE and the perspective of how the author can contribute to the innovations of GE. Thomas Edison established the Edison General Electric Company in 1890. The series of innovations in GE started from the founder himself who invented one of the greatest products of this age - the electric lamp. In 1892, the Edison General Electric Company merged with their competition Thomson-Houston Company amidst common interests to for the "General Electric Company". The GE Global research still honours the heritage, legacy & dignity of Edison in their R&D activities (http://www.ge.com/company/history/edison.html). In the modern business world, GE has a wide range of products in the fields of lighting, electrical distribution, renewable energy, aviation, healthcare, business & consumer finance, Oil & Gas, water treatment & processing, railroads, media & entertainment and security (http://www.ge.com/products_services/index.html). In the area of process innovations, GE is one of the first companies of the world to implement Six Sigma successfully. Goldstein, Mark (2001. pp37, 39) a Six Sigma consultant comments that the foundations of this best practice that was implemented in GE Appliances in 1995 (and later on rolled out to the rest of GE Company by year 2000 as per the target set by Jack Welch) is yet to be seen in any other organization. GE proved that best practices cannot be adopted for the name sake rather the fundamental commitment to them by virtue of the foundations of innovative culture makes the difference. GE thrilled the entire world by demonstrating the level of value addition that they could achieve to their top line and bottom line - that means increased revenues at reduced costs. It is the sound fundamentals of innovative business processes of GE that has ensured them to be in profit even in these tough times. At the end of financial year 2008, GE has built an overall market cap of $105 bill ion with Price/Earnings ratio at 5.60, Price/Sales ratio at 0.58, Price/Book ratio at 1.0 and Price/Cash Flow ratio of 3.6. The return on equity achievement was 16.60, return on assets was 2.20 and Return on investment as 4.0. Except Price per book that is evaluated in most recent quarter, all other figures published are trailing twelve months (http://money.cnn.com/quote/snapshot/snapshot.htmlsymb=GE). The net income of GE in 2005, 2006, 2007 & 2008 is $16.72 Billion, $20.742 Billion, $22.20 Billion and $17.41 Billion respectively (http://money.cnn.com/quote/financials/financials.htmlsymb=GE&sid=2148&report=2& period=1). The company presented impressive financial performance in the markets amidst global financial turmoil. The strength of GE has been built as a result of their remarkable contribution to the mankind that has changed the lives of people and the global economies as whole. GE has a major financial services business that is going to pose trouble to the overall organization given the turbulent times in the current scenario and the questions

All the presidents men. Movie review Assignment Example | Topics and Well Written Essays - 750 words

All the presidents men. Movie review - Assignment Example â€Å"All the president’s men film† is an accurately directed journalism film concerning the process used by the investigative reporters as the viewers may have any right to expect. This process finally overpowers the whole narrative. The viewer’s especially the aspiring journalists aimless in a pool of denials, evasions, false leads and a lot of coincidences due to lack of integrity in the whole of the investigative team report. These thousands of falsehood statements resulted into the Watergate attack and the resignation of Nixon (All the president’s men). The â€Å"all president’s men movie† is thus a more detailed film about journalism field rather than basing its facts on the results. This is not to say the movie is not a good one in the accomplishment of what it sets to deliver in as far as the field of journalism is concerned. This film provides a well-structured and observant study the working journalists. The outstanding features of the â€Å"all president’s men film† is portrayed in the characters such as Bob Woodward and Carl Bernstein. These two individuals are lucky after they had replaced Walter Burns and Hildy Johnson. This replacement succeeds in the suggestion of the mixture of self-doubt, courage, suspicion and excitement that heated the Washington Post headlines when two young prolific reporters who are Bob and Carl finally concluded their investigative report on the presidency. In deed, this was the peak of courage in the journalism field portrayed by this movie other than the revolving theme of conflict in it. The newspaper movies such as this one are usually used to drama up the exhilaration and ignore both the waiting feeling and boredom. This movie is all about the boredom and the cumbersome digging feelings in the waiting for the outcome in the final episode of the film. The thematic setting of this movie depends on what the viewer’s already know about the looming Watergate saga to provide a given quantity of excitement. Given the factual statements that William Goldman’s screenplay is almost in dialogue form, the journalists are able to follow this script more attentively and learn of the roots of conflict in the journalism field. Almost wholly, the â€Å"all president’s men movie† contain a sequences of scenes showing people either talking or completely silent with one another. Many of the upcoming journalists for Allan J. Pakula envy this aspect of journalism; the director of this movie has done a commendable job in the keeping of the pace stiff. The tensions

Understanding of relational and interpretive perspective Essay

Understanding of relational and interpretive perspective - Essay Example In this research language was identified as having several components including words and action. This was an important indication to refute the general misconception that language and communication are all about speech word and for that matter words. In fact, the seminar was an important avenue for realising the role that actions play in communication. Action was identified to be useful in forms of language such as non-verbal communication including gestures. Another core area of the seminar was that actions in language come with a number of relations. This opened the door to relating language to relational and interpretive perspective. This is because once the relations are made in the course of language, listeners and on-lookers make interpretations of the language that is put across to them. Two major theories were introduced by Gergen. These were centripetal and centrifugal power. It was realised that the effect of this power cause a lot of leaders of the world to resist change. Further discussions on the chapter and seminar have been done below. Discourse and analysis are coherent phenomenon. This is to say that discourse comes with analysis. Even in cases where discourse is soliloquy, it is very much likely to contain some level of analysis because the singular speaker may want to have some meaning out of what he or she says to him or her self. Ankati explains that even though there may be many definitions of discourse, â€Å"One thing they all agree on is that the analyst's first focus must be on language, and what it does in the world.† This means that the focus of discourse is on language. Norquist (2012) gives a linguistic definition to discourse, explaining it as â€Å"a unit of language longer than a single sentence.† This means that discourse entails the delivery of a series of sentences to put across a core message discourse of sadam hussein Discourse is an inevitable phenomenon in leadership at all levels. Corporate managers, paren ts and political leaders all use discourse to achieve various purposes. It is for the reason that people use discourse very often that there is the term, discourse practice. This discourse practice may be either through words or action. Among leaders of this world whose discourse practice are commonly analysed and discussed is Saddam Hussein. Very outstanding among the discussion of the discourse of Saddam Hussein is the political discourse he used over his people as the President of Iraq. From a very broad perspective, Bengio (2002) describes Saddam’s political discourse as one that is filled with propaganda. This, according to the writer created a phenomenon known as â€Å"Saddam enigma†. Like in the case of Saddam, Bengio (2002) notes that â€Å"under any regime, political culture is built on public discourse.† This means that the kind of political discourse that a ruler puts across has the power of creating an identical political culture. This political cult ure could be linked to the relation that people build towards the political regime in question. This therefore means that both relational and interpretive perspectives are represented in political discours

An Analysis of Literacy Essay Example | Topics and Well Written Essays - 750 words

An Analysis of Literacy - Essay Example Firstly, it must be understood that literacy in and of itself can and should be described as a type of awareness. As described by Paul Kei Matsuda in his piece, â€Å"Alternative Discourses: A Synthesis†, the definition of what specifically defines literacy evolves and grows as a function of type and nature of literature that exists within a particular period in time. As such, the reader can readily note the fact that what defined literacy within the 18th century might not necessarily be what defines literature with the current era. However, a thread of similarity and comparability exists between all levels of literacy. The similarity is with respect to the fact that the individual who is literate is both aware and able to express themselves with regards to salient topics within a range of different issues. This does not necessarily engender the fact the individual must be a polymath who is talented a great range of different subjects; rather, it denotes an individual that is capable and willing to research and litany of different areas and present a balanced and reasoned analysis that can readily be understood by even an individual is not an expert within the given field. From the information that was provided within James Gee’s article, â€Å"What is Literacy†, it can also be understood that a pitfall that many professors, and indeed universities themselves make, is with respect to formalize the discussion in seeking first English as second language and native speakers integrate with the topic. in a particular way. Ultimately, the author points to the fact that college and/or University should be to a period of time in one’s life that they are able to use as a means of expanding their horizons and honing their ability to create and argue a well reasoned point. Ultimately, rather than forcing a level of similarity of content, the author argues for the fact that the rhetorical analysis process in and of itself is the greatest virtue. Finally, a further point, and thread of similarity that exists between three articles, is referenced in the third and final argument that will be analyzed. The author of â€Å"Acquisition of Literate Discourse: Bowing Before the Master†, Lisa Delpit, denotes the fact that even though it is human nature to define and define people based upon their abilities, it is unfair and unreasonable to stipulate that an individual is somehow inherently incapable of creating a well reasoned argument within a written format. Ultimately, the case in point is provided, is that of a disadvantaged African-American female who, although her GRE scores were insufficient for admission, she nonetheless was able to develop or rhetorical skills and proved to be a successful writer and explicate or complex and nuanced ideas. Accordingly, the author helps to argue for the fact that grouping individual into the category of â€Å"unable to write† is somehow akin to the way in which individuals are grouped and discriminated against with regards to other categories. Ancient Indian Mathematics Essay Example for Free

Ancient Indian Mathematics Essay There are opposing views prevalent regarding the prominence of mathematics in ancient India. One, there are those who make excessive claims for the antiquity of Indian mathematics with the motive of emphasizing the uniqueness of Indian mathematical achievements. Whereas, the other conflicting views denies the existence of any ‘real’ Indian mathematics before A. D. 500. This view is the result of deeply entrenched Euro centrism that does not negotiate with the idea of independent developments in early Indian mathematics. Whereas mathematics grew out of philosophy in ancient Greece, it was an outcome of linguistic developments in India. In fact the algebraic character of ancient Indian mathematics is but a byproduct of the well-established linguistic tradition of representing numbers by words. ? Around 800 B. C. Vedic mathematics declined and Jains School of mathematics gradually which was to do notable work in the field. ? From about 200 B. C. was period of instability and fragmentation due to foreign invasions but also of useful cross cultural contacts. Probably the only piece of existing mathematical evidence from this period is the Bakhshali manuscript. ? This period ranges from 3rd to 12th centuries and is referred to as the classical period of Indian civilization. Mathematical activities reached a climax with the appearance of the famous quartet: Brahmagupta, Mahvika and Bhaskracharya. Indian work on astronomy and mathematics spread westward, reaching the Islamic world where it was absorbed, refined and augmented before being transmitted to Europe. This last period described as the medieval period of Indian history, saw the migration of astronomy and mathematics from the north to south. Particularly in present day state of Kerala, this was a period marked by remarkable studies of infinite series and mathematical analysis that predated similar works in Europe by about three hundred years. Harappan society was a highly organized society. There is every possibility that the town dwellers were skilled in mensuration and practical ar ithmetic of a bid similar to what was practiced in Egypt and Mesopotamia. Archaeological findings from that period provide the following indications of the numerate culture of that society: ? It shows uniformity of weights over such a wide area and time which is quite unusual in the history of metrology. Taking 27. 584 grams as a standard, representing 1, the other weights form a series of 0. 05, 0. 1, 0. 2, 0. 5, 2, 5, 10, 20, 50, 100, 200 and 500. Such standardization and durability is a strong indication of a numerate culture with wellestablished, centralized system of weights and measures. Scales and instruments for measuring length have also been discovered with remarkably high accuracy. A notable feature of Harappan culture was its extensive use of kiln-fired bricks and the advanced level of its brick-making technology. These bricks are exceptionally well baked and of excellent quality and may still be used over and over again provided some care is taken in removing them in the first place. Fifteen different sizes of Harappan bricks have been identif ied with standard ratio of the three dimensions as 4:2:1. It was thought until recently that from them evolved first the Bakhshali Number system and then the Gwalior system which is recognizably close to our present day number system. In both Bakshati and Gwalior number systems, ten symbols were used to represent 1 to 9 and zero. With them it became possible to express any number, irrespective of its largeness, by a decimal place value system. Long lists of number- names for powers of 10 are found in various early sources. In the Ramayana, it is reported that Rama had an army of 1010 +1014 +1020 +1024 +1030 +1034 +1040 +1044 +1052 +1057 +1062 +5 men. The very existence of names for powers of ten up to sixty two indicates that the Vedic Indians were quite at home with very large numbers. This is to be compared with ancient Greeks, who had no words for numbers above the myriad (104). The Jains who came after the Vedic Indians were particularly fascinated by even larger numbers which were intimately tied up with their philosophy of time and space. For units of measuring time, the Jains suggested following relationship: 1 purvis = 756 * 1011 days 1 shirsa prahelika = (8,400,000)28 purvis The last number contains 194 digits! The word numeral system was the logical outcome of proceeding by the multiples of 10. Such a system presupposes a scientifically based vocabulary of number names in which the principles of addition, subtraction and multiplication are used. Â  Due to oral mode of preserving and disseminating knowledge, the wordnumeral system persisted in India. As a replacement to this, a new concrete system was devised to help versification and memory, known as bhutasamkhya, wherein numbers were indicated by well-known objects or ideas.

Personal selling Personal selling is where businesses use the sales force to sell the product after meeting face-to-face with the customer. The sellers promote the product through their attitude, appearance and specialist product knowledge.  They aim to inform and encourage the customer to buy, or at least trial the product. A good example of personal selling is found in department stores on the perfume and cosmetic counters.   A customer can get advice on how to apply the product and can try different products.   Products with relatively high prices, or with complex features, are often sold using personal selling.   Great examples include cars, office equipment and many products that are sold by businesses to other industrial customers. Point-of-sale merchandising can be said to be a specialist form of personal selling.   POS merchandising involves face-to-face contact between sales representatives of producers and the retail trade.   A merchandiser will vis it a range of suitable retail premises in his/her area and encourage the retailer to stock products from a range.   The visit also provides the opportunity for the merchandiser to check on stock levels and to check whether the product is being displayed optimally. Advantages of personal selling are high customer attention; message is customized, interactivity, persuasive impact, potential for development of relationship, adaptable and opportunity to close the sale. Organization sell and customer buyer behavior in relation to purchase decisions Digital crameras and the washing machines products that selling at the Elec company. People buying Digital crameras and the washing machines for different purposes. First we have to identify the purposes of the customers before selling products. Digital crameras are mostly needed for the younger generation and photographers. But when we come to the washing machines, mostly it is important for women. Then the company have to use different ways to advertise their products. When the company is going to advertise for the washing machines, it is better to put those advertisements in a womens news paper rather than putting that advertisement in other newspapers. When selling digital crameras it is little bit different. When the company selling digital crameras it is better to advertise in commercial magazines than womens magazines. Washing Machine Buyers Digital crameras Washing machines are house hold items . It is already use in houses. When people wants to get a washine mechines they mainly focused about the price and the facilities in that. Consumers are individuals, households or businesses who use the products. Consumer characteristics vary from country to country. Therefore it has become challenging task for marketer to understand the need, buying behaviour of consumer before developing product and marketing program. It has been found that the consumers decision making process is influenced by Usability aspect. Here the peer group pressure, Promises, Digital Processing, Flash, Location services, Cost of service Spare parts cost combined together affect the consumer to decide while purchasing a digital camera. The feature of the product is next important factor that heavenly influences the buying decision of the consumer. Here the consumer pays a great attention towards features like Picture quality, Zoom facility memory of the camera. The accessories have become an important factor in purchasing a digital camera. Apart from the features, the customer is very much interested in other add-on  like colour, carriage bag, weight trendiness of the camera. Other factors that are crucial in decision making while purchasing digital camera are service, value for money promotional schemes. Price has not emerged out as a very crucial factor for the consumers. The consumers give more weight age to usability features of the product in comparison with price. Promotional schemes like discounts emerged out as the least important factor for the consumers. Role of the sales team The sales team is responsible for researching and analyzing the business and the market. Using the information gathered, the marketing plan, budget and key performance indicators are developed. Action plans are devised and the marketing strategy is implemented. The marketing department measures and reports on the results of the marketing strategy. Staff in the marketing department train staff in other departments so they are conscious of current campaigns. The purpose of their activity is to manage the four Ps of marketing. The aim is to stimulate demand for the business goods and services and to generate leads. Leads are customers who are likely to make a purchase. Leads are identified by collecting the details of people who contact the business to ask about products or services, or by gathering details of prospective customers from online surveys, competition entries or newsletter subscriptions. Lists of potential customers can be purchased and classified into ranges of income, loc ation and purchasing preferences. The marketing department can analyze their customer database to highlight customers and their preferences, those who make regular purchases or those who are due for upgrades or replacements. After raising interest and demand for the products and services, the leads that are generated are passed on to the sales department. Leads are people who may make a purchase. It is up to sales staff to contact people, identify their needs and help them make a purchasing decision. Sales staff deal directly with customers and they must build a good relationship. Sales staff also deal with people who walk in off the street or contact the business through their website. The role of sales staff is to make sure the business gets a return from its investment in marketing and to turn demand into sales. Corporate Sales Planning Elec is having multiple ranges of electrical and electronic home appliances to meet with different needs of the families. Company management is more focused on building a business which is sustainable and more profitable for the stake holders. Further they want to have the brand presence as well. The company vision is more focused on creating better values for their end users, sellers and other stakeholders. Further the company is looking for the growing opportunities with business expansion and new sales force recruitment. Moreover the company should develop and competitive environment for the target market to choose Elec products over the competitor brands. Elec management should understand the corporate objectives of their organization clearly and should develop the sales planning accordingly. The sales force management in the Elec Company seems to be very weak and the company is not having and efficient tracking system on the employee customer visit plans. The company is in a position where they have to make strong call on how they are going to manage their sales planning and client management. Elec as a importer and supplier of house hold electronics and electrical thorough out the country, the company should understand the need for designing a sales plan with clear reporting and account management guidelines. As the company is managing a considerable amount of resellers its will be better to change the sales representatives roles to Key Account Managers. Key account managers will be assigned with different shop owners who could be taken care by the respective account managers. Each shop will be considered as separate accounts. The account manager will be responsible to handle any queries related to the accounts under his observations. When the company is designing the account managers reporting lines it can have a 2 layer or 3 layer reporting line. The overall sales and distribution operation would be handled by the country head for sales. And he can have three Senior Sales managers reporting to him, who will be responsible to handle the account managers. The account management can be differentiated into two main criteria. The first criteria would be the large resellers who by more than certain quantity every year. The company can check their past sales records and list the top 25 B2B buyers as the Key Accounts of the company. And the Key accounts can be handled by the Key account managers while the other B2B customers can be handled by the other customer account managers. Among the 3 senior sales managers one manager should handle the Key account Managers who will be handling the main customer accounts of the company while the other 2 senior managers could handle the other customer account operations. When assigning the account managers to the resellers other than the key account managers, the company may practice a territorial approach. This will help the company to plan their sales operations effectively. Same way the company can divide their key accounts into 3 or 4 territories which will make the client management and customer visits more convenient. Company can figure out the compatible staff from the current sales force and promote them as key account managers. If they give the internal staff, the opportunity to handle the key accounts, it will be much convenient for the company to have the rapport with the existing customer hence they already have some kind of relationship among them. Proposed Hierarchy of the Sales Department at Elec Company Country Head Country head for sales should be responsible for overall sales planning and budgeting of the department. The country head will be a member of the senior management team and will have the sales planning with the corporate objectives. He will play a major role in communicating the overall organizational expectations with the sales unit staff. He should have the capacity to develop a sales design and make rapid decisions based on the customer and corporate demands. Senior Manager Key Accounts Senior Key accounts Manager will be handling a team of Key account managers who will be responsible for delivering the set profit targets and achieving the organizational goals. Further the managers will be responsible to manage the account managers reporting to him and to provide them better guidance in delivering satisfactory performance. Further the senior account manager will also have occasional liaisons with the key clients. Senior Manager Customer Accounts Management Senior Manager will be responsible for handling the staff directly reporting to him and growing the unit performance. Also increasing the profitability of the sales team will be a major goal of the manager. Managers will also handle the customer grievances and provide professional guidance to the team members in personality development and business development. Key Accounts Manager Key account managers will have the direct liaison with the key customers assign to them and increase the companys profitability and developing the brand presence in the assigned region. Also they will be responsible to retain the customers and grow the portfolio size. Customer Account Managers The customer account managers will be responsible to handle the customer accounts of the company from the assigned territorial limits. The Account will be handled in terms of increasing sales and convincing the accounts to promote the Elec products over the competitor products. Also the Account managers will be responsible to have sustainable account management and relationships with the customers. Restructuring the sales department should be planned properly as the changes take place in the company to avoid the staff getting the wrong message. The company should give the existing staff more priority for the appropriate positions. And the company should have a clear change management strategy in the role changes and planning. Human Resources Management Human resources management functions related to the sales department will include staff retention, employees welfare management and motivation, recruitment and selection, training and development and Employees Evaluations and other activities related to the staff management. Human Resources Planning for the Sales Unit Human resources planning process involves identifying the need for human capital against the organisational goals and current human capital strengths. Any company in the market should do a human resources planning in order to have a competitive human resources and enjoy the economies of scale. Any decision on recruitment should be made only if the necessity is found through a human resources planning activity, if not the recruitment may be a burden for the organisations future. At Elec, as the company is planning on expansions and growth, the company is in need for more staff to match the need of the sales expansions and adoption of new customer accounts. Human resources planning will have several sensitive steps which need to be carried out with strategic thoughts and information. Evaluating the organisational goals and objectives This should be found from the top management decisions and needs. Identifying the need of human resources (Human resources Demand) The company HR should negotiate with the line managers and middle managers on the need of employees for the achievement of set objectives. The need can be identified by the average productivity assumptions. Identifying the currently human resources availability (Human resources Supply) Gather information from the HRIS or from departmental managers and payroll system on the availability of staff power. And the skills of the employees should be also identified. Evaluating the gap between supply and demand. The management should evaluate the gap existing with the demand and supply of human resources and the skills. Planning the strategies to meet the required human resources level. If the supply and demand is matching the company could focus on training and developing the employees to achieve the goals. If the company has staff surplus, it should implement strategies to downsize the human capital, if not they can reduce the working hours of the employees or prepare rosters for working. But the company may focus on new account adoption and increase the targets of the staff that are with little portfolios. If the company has a staff shortage the company can increase the working hours of the staff and pay overtime or if the need is a long term oriented, they can recruit new employees. Also they can outsource few functions which are not core activities of the business. Implementation of the plan and monitoring the process as a continuous cycle. The activities planned should be implemented and monitored to assure the execution aligns with the planning. And the planning process is a recurrent process which needs to be carried out frequently to assure the human capital is utilised effectively. The above HR planning process should be carried out on a frequent manner to understand the companys sales departments position based on the human resources need. This will help the managers to understand the over heads and shortfalls in the unit. Recruitment and Selection Process The need for recruitment would be identified through an effective HR planning process. ELEC should make their recruitment decisions by carrying out HR Planning activity. If the recruitment is done just for the request of the department managers the company may have to suffer unnecessary financial losses. The recruitment and selection process of the company should be strategically designed to match with the company culture and the industry they operate in. Recruitment and selection process may have the following steps in general. Analysing the vacancy identifying the job role and specialities need for the job role. Analysing the skills and qualifications expected to meet the vacancy. Identify the personality needed from the individual for the position vacancy. Identifying the recruitment method whether the company is planning to fill the vacancy from the internal staff or looking from outside. The company can call applications though education and professional bodies, via referrals and public advertising, etc. Selection process Screening the applications received to identify the qualified candidates. Preliminary interviews for the shortlisted candidates Exams/tests related to the job for the successful candidates Next level of interviews Reference checking and background analysis Offer of employment Acceptance by the employee and employment contract. Induction Evaluation of the Selection process The above procedures could be followed by the ELEC to recruit a suitable candidate for the vacancies. Elec can recruit staff with experience in the same industry and can attract staff members from their competitors by giving better benefits for their staff members. Selecting and recruiting the most suitable candidates will help the company to have a committed staff force who will help the company in achieving the competitive advantage over the competitors. Employees Motivation Elec Company should implement a better employee motivation system as the current system in the company is not very competitive to have a satisfied and motivated sales force. In order to have a motivated sales team the company should focus to develop a satisfied sales force and then motivating the sales team. If the company invests on employee motivations without achieving the employee satisfaction the company many suffer unnecessary losses. The company should make the employees to feel that they are being taken cared by the company and if they perform more the company will reward for their additional contribution. Company should take initiatives to hear the employee grievances and provide proper solutions to match their needs. The company can include employee protection schemes with insurance benefits and health protection for the staff and immediate family members. Also the company should introduce a competitive rewarding scheme based on the account management profits generated by each account manager. This will give them the motivation to focus on increasing the sales and build a strong business portfolio for their benefits and organizations benefit. In addition Elec can introduce a sales tracking mechanism which will provide the staff real time updates on their portfolio position and how their monthly incentives are going to be. Also if the company can introduce Tabs or laptops for the sales staff to have communication medium with the head office and to see the stock in demand and orders to the stores based on the clients needs. This will reduce the companys operational cost on communication medium though the initial investment may look higher. Further the company should have employee get together, family outings and special value adding rewards such as MDs awards to recognize the employees for their extraordinary contribution to the company growth. In addition to the above the company should invest more on the employees training and development. This will help the employees to have a trust on the company. Also they will be happy to see themselves growing within the company. Marketing Mix and Business Development Company should develop a marketing mix based on the corporate strategy of the company. The marketing mix will focus on the competitive advantage over the competitors. The Elec products are tangible and the consumers always want to have key benefits and values to be matched for the money they pay. Elec should evaluate the cost benefits before designing the marketing mix of the company. The marketing mix will be more focused of reaching the shop owners than the end users as the shop owners will be focused on sales growth to end users. Elec should build good rapport with the shop owners and identify the product movement style and analyze the best markets places for the range of products they have. They should provide the right products and the right quantity to the right shop to avoid returns of the goods which will cost extra on transport. Further the company should fix a price which will give better yield for itself, shop owners and cost advantage for the end users. Also they should match their prices with the main competitors to win in the price competition. The Company will have their main stores based on the head office and distribute the goods every fortnight based on the orders received. This system will help them to enjoy the cost advantage again without having many distribution centers. The market placing will be done through the account managers to the shops they manage. And the end users can buy the products from the shops hence the company doesnt need to meet the end user directly. Further the company could train the shop technical staff on the repairs and damage complain handling which will help Elec to have a professionalism in the shop level as well in treating the customers fairly. Also this will help the shops to be satisfied with the support given by Elec. Promotional activities related to the product range will be handled by the Elec corporate office. The promotional activities of the company will have 2 phases where one phase will be focused on the shops and the other phase will be focused on the end users. The public media advertising will have more focus on the general public and end users. But the advertisements done for the end users may have considerable influence on the decision making of the shop owners as well; hence the message received from the media will create a stereo typing on the shop owners mind. The company will carry out personal marketing to the shop owners with the support of the technical sales team and the account manager. Also the senior managers will be getting involved in negotiating the wholesales pricing and the profit margins with the shop owners. International movement of the company is pretty competitive. As the company is still focusing on establishing the brand in Sri Lanka they should do a feasibility study on the competitiveness and profit advantage of entering a new international market. Participating in Trade fairs will help the company to meet the end users in the selected area and identify the real needs and demands of the end users than they learning from an intermediary. Also they can learn about the influences of the other brand in the customer decision making process. Conclusions In summary Elec should develop a sales plan focused on account management concept and differentiate the account based on the profitability and turnover. The high profitable accounts will be managed by the key account managers and the other accounts should be managed by the customer account managers. The company may have to invest more on developing a professional account management team. Further the company has to invest in recruiting the best candidates and training them. The marketing mix of the company should be restructured to match the organizational overall expectation and the company can have products distribution strategies to match the regional demands. Also the whole sale pricing should be negotiated with the key customers and the senior managements involvement is much appreciated on this. Also the company moving international is not recommendable at this point of time hence the company is in need of more cash to stabilize themselves in the local market.
